Terms and Conditions for Cutify AI

Welcome to Cutify AI! By accessing or using https://cutifyai.com (the "Site") and our services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Using Cutify AI
To use Cutify AI, you must log in with a Google account. You are responsible for maintaining the security of your account. You must not use the Service for any unlawful purposes or violate any applicable laws.

2. Ownership & Usage Rights
When you upload a photo and generate AI images using our Service:

You own the final AI-generated image.

If you're on the Basic Plan, you may not resell or commercially use the image (e.g., for business, ads, or NFTs).

On the Pro or Premium Plan, you have full commercial rights to use and resell your AI-generated images.

You retain rights to your original uploaded photo. We do not claim ownership of your input images.

3. Refund Policy
We offer self-serve refunds under specific conditions:

If you've generated fewer than 3 photos in total, you can request a full refund from your account dashboard.

For accidental yearly plan signups, a refund is available if you've generated fewer than 10 photos.

Once you've passed these thresholds, we cannot issue refunds due to high GPU costs from our AI infrastructure providers.

You may cancel your subscription anytime to stop future billing.

4. Content Guidelines
Do not upload images that contain:

Nudity or sexually explicit content

Violence or hate symbols

Copyrighted material without permission

As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Service. By way of example, and not as a limitation, you shall not (and shall not permit any third party to) take any action (including making use of the Site, any Assets or our models or derivatives of our models) that: would constitute a violation of any applicable law, rule or regulation; infringes upon any intellectual property or other right of any other person or entity; is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, obscene, offensive, furthering of self-harm or profane; creates Assets that exploits or abuses children; generates or disseminates verifiably false information with the purpose of harming others; impersonates or attempts to impersonate others; generates or disseminates personally identifying or identifiable information; creates Assets that implies or promotes support of a terrorist organization; creates Assets that condone or promote violence against people based on any protected legal category.

We reserve the right to suspend accounts that violate these terms.

5. Service Availability
We strive to keep the service online and fast, but we can't guarantee uninterrupted access. We may modify or suspend features at any time without notice.

6. Termination
You may delete your account at any time. We reserve the right to terminate accounts for misuse, abuse, or violations of these Terms.

7. Limitation of Liability
Cutify AI is provided "as is." We are not liable for any damages resulting from your use of the Service. Maximum liability is limited to the amount you paid us in the past 12 months.

8. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we'll notify you by email.
